Terms of Service

These terms are the agreement between you and Dia. By downloading or using the app, or by joining the waitlist, you agree to them. If you do not, please do not use Dia.
1. Who can use Dia
You must be 18 or older, and able to enter a binding contract where you live. Dia is designed for adults managing diabetes of any type. It is not for children, and it is not built for managing diabetes during pregnancy or under acute or hospital care.
2. What Dia does, and what it does not
Dia explains glucose data you already collect. It is an educational and informational tool.
Dia is not a medical device and gives no medical advice. It does not diagnose, treat or prevent anything, it will never tell you how much insulin to take, and it does not replace your CGM, your meter or your care team. Read the full Medical Disclaimer — it is part of these terms, and it is the part that matters most.
3. Your account
You can use Dia as a guest or sign in with Apple. You are responsible for what happens under your account and for keeping access to your device secure. One account is for one person — please do not share it.
Everything you log belongs to you. We do not claim any ownership of your health data, and we will not use it to train AI models. You can export all of it or delete all of it from inside the app at any time, whether or not you are subscribed.
4. Subscription, trial and billing
Dia is a paid app with a free trial. There is no permanently free tier — the whole app, including everything AI-powered, is included in the subscription.
- One month free. You add a payment method when you start, and you are not charged during the trial. Apple’s offer is one calendar month, so the exact renewal date depends on when you begin — the app always shows you that date.
- After the trial: $8.99 per month, or $59.99 per year. Prices are in USD and may differ in your local store.
- A reminder before the charge. We notify you a week before the trial ends, naming the date and the amount, so the first charge is never a surprise.
- Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
Billing is handled by Apple through your App Store account, not by us — we never see your card. Cancel any time in iOS Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep access until the end of the period you already paid for. Deleting the app does not cancel a subscription.
Refunds are handled by Apple under their policy, at reportaproblem.apple.com. We cannot issue them ourselves. If something went genuinely wrong, write to us anyway and we will help you make the case.
If we change the price, we will tell you before it applies to you, and you will have the chance to cancel first. Beta testers keep the terms they were promised when they joined.
5. Fair use
Please do not:
- Reverse-engineer, decompile or resell the app
- Use it to provide medical services to other people
- Script or automate it, or hammer our servers
- Upload anything unlawful, or anyone else’s health data without their consent
AI features have daily limits to keep the service affordable for everyone. We may adjust them, and we will not do it quietly.
6. Third-party data and services
Dia reads from Apple Health and, if you connect one, from your CGM. It also relies on third-party services listed in our Privacy Policy. We are not responsible for the accuracy or availability of data those services provide, nor for the devices themselves. Their terms apply to your use of them.
7. Our intellectual property
The app, its design, the Dia name and mark, and everything we write in it belong to us. You get a personal, non-transferable, revocable licence to use the app for your own diabetes management. That licence does not transfer any ownership.
8. Availability
We will try to keep Dia working, but we do not promise it will be available without interruption or free of errors. We may change features, and we may discontinue the service — if we ever shut it down, we will give you reasonable notice and a way to export your data first.
9. Disclaimer of warranties
To the fullest extent the law allows, Dia is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the insights, patterns or AI-generated text are accurate, complete or suitable for any decision about your health.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from a decision you made about your health based on the app. Our total liability for any claim is limited to the amount you paid us in the 12 months before it arose.
Nothing in these terms excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow some of these exclusions, in which case they do not apply to you.
11. Ending it
You can stop using Dia whenever you like, and delete your account from inside the app. We may suspend or terminate an account that breaks these terms, or where we are required to. If we terminate your account without cause, we will refund any unused portion of a subscription you paid for.
12. Changes to these terms
We may update these terms. If a change is material, we will tell you in the app before it takes effect. Continuing to use Dia afterwards means you accept the new version. The date at the top is always the current one.
13. Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. If you are a consumer in the UK or EU, this does not deprive you of the protection of the mandatory laws of the country you live in, or of the right to bring proceedings there.
